In Virginia, Can an Injured Employee Receive SSDI and Workers’ Compensation Benefits?

What is Workers' Compensation Insurance?

In Virginia, the Workers' Compensation Commission oversees the workers' compensation insurance system to ensure that individuals injured on the job receive the financial benefits they are owed under state law. The amount of workers' compensation an injured employee receives depends on multiple factors, such as the type and severity of the injury and the employee's income before the injury.

Workers' compensation insurance is available only to individuals injured on the job. An individual with a disability that is unrelated to a workplace injury is not eligible for workers' compensation benefits.

 

What is Social Security Disability Insurance?

The Social Security Administration (SSA) manages the federal SSDI program. SSDI provides financial benefits to individuals who are unable to work due to a qualifying disability.

An individual may receive SSDI benefits for any qualifying disability, regardless of whether it arose from a workplace accident or injury.

 

Can I Receive Both SSDI and Workers' Compensation Benefits?

Yes. An individual may be eligible and receive both workers' compensation insurance benefits and federal SSDI payments.

Importantly, an individual's total benefits cannot exceed 80 percent of their average current earnings before becoming disabled. The SSA will reduce an individual's SSDI payment to ensure the combined benefit does not exceed 80 percent of their average current earnings.
